Data Processing for Contract Execution

(1) When you engage us to pursue your compensation claim, we process your contact, communication, contract, and flight data (e.g., flight number, date, time) to provide our contractual services as outlined in our General Terms and Conditions (especially to pursue the compensation claim). Your contact and flight data are essential for contract formation, and without this information, a contract cannot be concluded. We may share your data with supporting service providers (e.g., hosters, communication application operators) who have been carefully chosen and are bound by our instructions. This especially applies to technical service providers assisting us in service provision.

Your payment data is not required or processed until a payment is due to you.

(2) As specified in our terms and conditions, if our extrajudicial efforts to recover the claim are unsuccessful, we instruct contract lawyers to represent your interests. Therefore, the legal basis for data processing to fulfill the contract is Article 6, paragraph 1, lit. b GDPR.

(3) In addition to our General Terms and Conditions, our cooperation agreement is based on your chosen form of cooperation (Basic or Premium). The terms of service of our contract lawyers also apply. Data processing takes place based on the specific contractual agreement.

(4) We also process the data for service optimization. This includes checking your data against known Blacklists.

(5) Additionally, we process your data based on legal obligations (e.g., based on tax regulations) and to protect legitimate interests.

(6) To ensure contract performance, we need the following personal data:

The legal basis for data processing is Article 6, paragraph 1, lit. b GDPR, and § 25, paragraph 2 TTDSG.

(7) Data processing to fulfill contract services is only possible if you provide the data required to process your request. Data marked as mandatory is essential for contract execution. Data not required for contract execution is optional. If you don’t provide optional data, it won’t impact your ability to fulfill the contract.

Data Processing for Payment Processing

For payment processing, we use trusted payment service providers. We don’t collect or store any payment-related data like credit card numbers or bank account details. Payment transactions are subject to the terms and conditions and privacy policies of the respective payment service providers.

The legal basis for data processing is Article 6, paragraph 1, lit. b GDPR.

Data Processing to Fulfill Legal Obligations

In addition to processing data to execute contracts, we are subject to various legal obligations requiring us to process personal data, particularly to meet tax obligations. The legal basis for this is Article 6, paragraph 1, lit. c GDPR, and § 25, paragraph 2 TTDSG.

Data Processing Based on Legitimate Interests

(1) If necessary, we process your data beyond contract fulfillment or legal obligations to safeguard our legitimate interests or the interests of third parties, except where your data interests, fundamental rights, or fundamental freedoms take precedence.

We only disclose your data to government bodies within the scope of legal obligations, as well as for legal enforcement in case of attacks on our network infrastructure.

(1) Your data is processed to fulfill contract services based on contractual agreements. Data required to fulfill a contract is stored for as long as required for contractual purposes.

(2) We are obligated to store this data for tax and accounting purposes. In accordance with statutory obligations to retain records, this data is stored for 7 years.

(3) If the data is no longer required for contract execution, it is deleted, unless continued storage is required for legal purposes.

Right to Object

You have the right to object at any time to the processing of your personal data due to your specific situation, based on Article 6, paragraph 1, lit. e, or lit. f GDPR.
