How Do I Submit My Documents to EUSVC?

Upon submitting your claim via our website, you'll have the opportunity to upload your boarding passes directly on our website. If you don't have your flight documents on hand when opening your claim, you can send them later via E-mail. Comprehensive instructions will be provided in the email we send you upon claim submission. It's also possible to transmit your documents through email, WhatsApp, Social media platforms, postal mail, at any time.

Can I submit a claim if I missed the connecting flight?

Yes, you are eligible for compensation if your missed connection resulted in you arriving more than three hours late at your final destination with an alternative flight provided by the airline.

Can you pursue a claim against airlines that have declared bankruptcy?

In cases like this, our ability to ensure success may be more limited.

How can I initiate a compensation claim for a minor?

In the case of a minor passenger, a statement from a legal representative is also required, and the representative's personal details must be provided.

How much compensation can I receive for intra-Community flights over 3500 km?

Passengers whose flights have been delayed by 3 hours or more are entitled to a maximum compensation of EUR 400 for all intra-Community flights exceeding 1500 kilometers.

Do I have to pay a success fee if I have insurance?

If you have travel insurance, we will pay you 100% of the compensation in the event of a successful claim process.

What should I do in the event of denied boarding? Am I eligible for compensation?

Yes, you may be entitled to compensation. It's crucial to have proof (e.g., a record signed by the airline) that boarding was denied against your will, even though you checked in at the gate with a valid boarding pass and travel documents, properly sized packages, and in good travel condition, and did so at the correct time.

In what currency will I receive the compensation?

The transfer will be made in EUR but will be converted into the currency of the bank account you provided.

When is my claim ready to be submitted to the airline?

Your claim is ready to be submitted when the correctly filled and signed contracts are returned to us, either by uploading them to your case or by sending them to claim@eusvc.com.

Can an infant (2 years old or younger) receive compensation?

If you have paid for your baby's ticket, then your baby is entitled to compensation.

Can I receive compensation if I had a free ticket?

This Regulation does not apply to passengers traveling free of charge. Therefore, in this case, you cannot claim compensation.

Who is entitled to compensation (the person who paid for the flight ticket or the passenger)?

The EC Regulation pertains to the rights of the passenger who experienced the issue, rather than the individual who paid for the flight ticket. In all instances, the passenger is entitled to compensation.

From which airline can I expect the compensation?

Compensation is owed by the operating airline, which is not always the same as the airline from which you purchased the ticket.

Can the airline reduce the compensation by 50%?

For flights exceeding 3500 km, if the arrival delay is more than 3 hours but less than 4 hours, the operating air carrier may reduce the compensation amount (based on distance) by 50%.

Is there a time limit to file a claim?

The right to compensation does expire. Generally, a claim can be submitted up to 3 years after the flight date. However, the time limit can vary from country to country (e.g., in Hungary, you have 5 years) or may be specified by the airline in their General Terms and Conditions of Carriage (GTCC).

Can I submit a claim for other passengers as well?

Absolutely, you may submit a claim on behalf of fellow travelers you journeyed with. You can also file claims for affected passengers even if you weren't a passenger yourself. Keep in mind that, in such cases, the actual passengers will be contacted directly. If you wish to act as a contact person, you may provide your email and phone details in the designated information fields. However, please refrain from listing yourself in the claim if you didn't travel. It's essential to note that only the actual passengers are eligible for compensation, irrespective of the trip's financial arrangement or the claim's originator.

How long does it take to receive compensation through EUSVC?

The duration of the process cannot be determined in advance. However, clients can monitor the status of their case on our website using their case ID, provided during registration.

How much compensation can I receive through EUSVC?

The compensation amount depends on the length of the entire route and may be either EUR 250, 400, or 600 per passenger.

Why do I need EUSVC?

Filing a claim, even under EC Regulation 261/2004, involves a lengthy administrative procedure, and having proper legal representation is essential. Airlines often reject claims with various excuses. EUSVC offers expert assistance to expedite the claiming process and ensure that the due compensation is paid promptly.

For what flights is EC Regulation valid?

The Regulation applies to all air travel within the European Union, whether by Community or non-Community air carriers. It also covers flights departing from the EU and arriving outside the EU or departing from outside the EU and arriving in the EU. In the latter case, the operating air carrier must be registered in the EU. This Regulation is directly applicable and binding not only in Hungary but in all 27 EU Member States. Furthermore, the rules apply in the countries of the European Economic Area (EEA), including Norway, Iceland, Liechtenstein, and Switzerland.

What is EC Regulation 261/2004?

It's a Regulation of the European Parliament and of the Council that establishes common rules regarding compensation and assistance to passengers in cases of denied boarding, cancellation, or long flight delays. (Regulation (EC) No 261/2004)

When should the airline offer ticket reimbursement?

In the event of flight cancellation, even due to extraordinary circumstances, airlines must offer passengers reimbursement of the full ticket cost and any additional costs incurred due to the cancellation. In many cases, airlines may offer a travel voucher, but passengers are not obligated to accept it.

How Much Does It Cost?

Upfront, nothing. EUSVC operates on a "no-win, no-fee" basis, meaning there are zero costs for you if your claim doesn't succeed. If we successfully secure your compensation, our standard procedure involves transferring the funds to you once received from the airline, minus our success fee of 20-30% (+VAT). In cases where our contract lawyers are required, a surcharge of 14% applies, but only if your claim succeeds.

My Flight Was Part of a Package Holiday. Am I Still Entitled to Compensation?

Certainly, package holiday travelers retain the same rights and claims under the Air Passenger Rights Regulation.

My Delay Was Less Than Three Hours but Resulted in a Missed Connection. Do I Have a Claim?

If a disruption during your flight causes you to miss a connecting flight and results in a delay exceeding three hours at your final destination, you have a valid claim with EUSVC. To qualify, the flights must share the same reservation number and be operated by the same airline or under a codeshare agreement, such as British Airways and American Airlines. If you're uncertain about including your connecting flight in your claim, please provide the connection details when creating your case, and we'll verify it for you.

Does EUSVC Handle Claims for Additional Costs?

Currently, our focus is on enforcing claims related to flight delays, cancellations, or denied boarding. If you incur extra expenses, you may directly submit the necessary documents to the airline. This does not diminish your chances of success in your case.

Should I Keep All My Flight Documents?

Absolutely! Please retain all flight documents, including your booking confirmation, boarding passes, and delay/cancellation confirmation. If your travel involves Spain, France, or Italy or you fly with an airline based in these countries, boarding passes are especially crucial. Even if you lack these documents initially, rest assured you can still file a claim with us. We initiate most of our claims without documents, requesting them only when absolutely necessary.

When Do Contract Lawyers Get Involved?

EUSVC collaborates with contract law firms across Europe to handle court enforcement. We, as a company, do not have the capacity to represent you in court. Therefore, if the airline refuses to pay and court proceedings are necessary, we recommend engaging our contract lawyers.

Do I Have to Pay Legal Fees or Lawyer Costs?

Engaging our contract lawyers carries no financial risk. In cases of a lost or partially lost court case, EUSVC alone bears all the costs. In the event of a settlement, costs will be deducted from your compensation with your consent. Please note that our success fee will be recalculated based on the total compensation awarded after any reductions, ensuring it's fair.

How Will Compensation Be Paid?

We disburse compensation to our customers via bank transfer. You're only required to share your bank details once we've successfully secured your claim. This information can be securely provided through our website or in writing via E-mail, Please be aware that some airlines make direct payments to passengers. If this occurs, inform us promptly, and we'll provide instructions for transferring our commission fee (+ VAT) to our account.

What Is an IBAN Number?

The IBAN, or International Bank Account Number, is crucial for transferring compensation to you. It typically consists of 22 alphanumeric digits, including a country code at the beginning. You can locate your IBAN on your bank statement or obtain it from your bank. It's used exclusively to credit or transfer funds into bank accounts and cannot be employed for debits, withdrawals, or transfers.

The Airline Has Contacted Me Directly. What Should I Do?

It's not uncommon for airlines to reach out to our clients directly once they've received our payment request. In such cases, please notify us immediately and forward any correspondence from the airline. Remember that we're entitled to our success fee if you're paid directly following our contact with the airline.

I've Received a Summons to Appear as a Witness in Court. Why Am I Being Summoned?

Airlines sometimes employ a defense strategy that questions the formal assignment of claims to EUSVC by the passenger or disputes the origin of the signature for the assignment. This tactic is used to prolong legal proceedings and potentially dissuade passengers from pursuing their claims. Generally, the simplest approach is to respond to the court's questions briefly and truthfully and return the documents as requested.
